Near Accident, a question of fault/ liability
I always brake deliberately (kidding...don't get too upset Tom...I know you don't trust accountants).
Something like this actually happened to a friend of mine (I was in the car). The car in front of us slammed on the brakes for seemingly no reason (she later said she was scared the light would turn red...although it was green) and my friend swerved as he hit the brakes to avoid her. The car behind us swerved & hit us...the car behind them hit them...car behind them...hit them. She was all upset & got out to ensure people were ok & such (she didn't seem a bad person or anything...just a horrible driver). When the cops came & got the whole story, they cited her & per my friend...her insurance ended up paying for his car's damage. I'm not sure if she got a reckless driving ticket or just what, but it seemed he was held liable for at least my friend's car (and assuming the others as well). That said...I'm sure every situation is different & not every driver who does something idiotic like this will fess up to it (let alone stick around).
I recall a few years ago in San Diego there was a pile up of cars due to some crackpot darting in & out of lanes. While the car darting around did not get hit, the local news was stating the SDPD were looking for that car as it caused the accident.
